In compliance with the Federal Law of Protection of Personal Data in Possession of Individuals, its Regulations and the interpretation criteria issued by the National Institute of Transparency, Access to Information and Protection of Personal Data, (hereinafter "the law"), we inform you that FUNDICION INYECTADA DEL CENTRO, S.A. DE C.V. is the entity Responsible for the processing of personal data obtained through the invoicing issued and received by the company as well as through our video surveillance systems and recruitment controls performed to our staff.   • Financial data: Payment information, number, type and ownership of bank cards, solely for the purpose of payment of the services purchased.

The Responsible may collect your personal data in the following ways: when you provide them to us personally; through our video surveillance system present in the offices of FUNDICION INYECTADA DEL CENTRO, S.A. DE C.V. in the case of your image; e-mail, contact form present in our site http://fincsa.com/, by telephone and through invoices, in the case of these, including those issued by and those received by FUNDICION INYECTADA DEL CENTRO, S.A. DE C.V.

In the collection and processing of personal data that you provide us, we comply with all the principles that allow us to offer you professional service of the highest quality, simultaneously complying with the guidelines set by law: Lawfulness, quality, consent, information, purpose, loyalty, proportionality and responsibility.

In the specific case of your sensitive data, the Responsible does not collect this type of data.

The veracity of the data you provide is under your responsibility, so FUNDACION INYECTADA DEL CENTRO, S.A. DE C.V. cannot be held responsible for the authenticity of such data at any time.

III. Purposes of Personal Data Processing.

The Responsible will collect your Personal Data without the purpose of disclosure or commercial use, and will only be used for the following purposes:

  • To provide the services and products we offer.
  • Maintain a database of persons who provide personal services subordinate to the persons in charge, as well as of candidates aspiring to provide personal services subordinate to the persons in charge.
  • Maintain a database of persons who provide professional services that are not subordinate to the persons in charge.
  • To comply with the obligations contracted with our personnel and independent professionals, as well as to evaluate the quality of services.
  • Carry out invoicing and payroll.
  • Formalize in contracts and agreements the relationship generated between you and the Responsible Parties.
  • In the case of the treatment of your image through the video surveillance system, the purpose ir to promote your security and that of the company as well as to safeguard the physical integrity of our customers, employees, suppliers and all persons who visit our facilities.

Your personal data will be kept under the strictest confidentiality and may not be used for purposes other than those mentioned above unless there is change to this Privacy Notice and your express consent to such change is obtained.

Once the purpose of the processing of your personal data is fulfilled, they will be blocked for the sole purpose of determining possible liabilities in relation to their processing, until the legal or contractual statute of limitations period. During this period, personal data may not be processed and after this period, they will be deleted from the correponding database.

In the case of personal data consisting of your image, captured through the video surveillance system present in our facilities, such information will be deleted after 15 days from the date of recording, and you may exercise your rights A.R.C.O. in the case of so wishing in accordance with the provisions of point VII of this Privacy Notice.

The Responsible Party states that it has made the necessary administrative and training efforts to establish internal regulations that do not impose discriminatory requirements for entry and permanence in the company.

IV. Transfer of Personal Data.

FINCSA does not sell, assign or transfer personal data to any entity or individual, without the prior express consent of the owner of the data. Any transfer of personal data made by the Responsible will be only for the purposes permitted and required by law, e.g. through the requirement of a judicial authority.

V. Security Measures/Access Limits.

The Responsible has adopted the necessary and sufficient technical, administrative, physical and electronic security measures to protect your personal data against damage, loss, alteration, destruction or unauthorized use, access or processing.

Personal data are safeguarded in databases and computer equipment that have the necessary security to prevent information leaks. Physical and logical access controls, anti-phishing training, anti-intrusion protection systems, antivirus protection tools and web filtering are some of the tools used to maintain data security in the Responsible's information systems.

The IT security tools mentioned in the previous paragraph are supported by an internal information security policy that includes continuous training of authorized personnel to identify, prevent and eliminate IT threats.

Only authorized personnel who have complied with and observed the correponding confidentiality requirements may participate in the processing of your personal data.

In the event of any security breach, The Responsible will inform the holder of the nature of the incident; the personal data compromised; the recommendations to the holder about the measures that he/she can take to protect his/her interests; the corrective actions taken immediately and other relevant information for the resolution and prevention of a future breach.

Therefore, you are hereby informed that the Responsible Party makes available to you a mechanism to request the limitation of the use or disclosure of your personal data subject of this Privacy Notice, by submitting a letter addressed to the Personal Data Processing Area (at the address indicated in point VI below).

VI. Area in charge of handling and administration of Personal Data.

The Personal Data Processing Area designated by FINCSA is located at Roberto Díaz Rodríguez 401. Cd Industrial. C.P. 20290, Aguascalientes, Aguascalientes with an opening hours from 8:30 a.m. to 17:00 p.m. from Monday to Frday, the same addess where we make available this privacy notice as well as the forms for accessing you rights of Access, Rectification, Cancellation and Opposition ("ARCO" rights).

VII. Rights that correspond to the holder of Personal Data.

As the owner of personal data, you ay exercise before the Personal Data Protection Area, the rights of Access, Rectification, Cancellation and Opposition ("ARCO" rights).

Likewise, you may revoke, at any time, the consent you have given and that is necessary for the processing of your Personal Data, as well as limit the use or disclosure of the same, under the understanding that such revocation may limit or prevent the continuation of the cotracted services, given the nature of the same.

Although you can obtain for your convenience the printed forms for accessing your ARCO rights at the address indicated in point VI, such formsare merely a non-binding guide, since you can exercise them through a free written request that must contain and by accompanied by the information and documents indicated in the Law, which include, but are not limited to, the following:

  • The name and address of the owner or other means of communicating the response to your request.
  • The documents proving its personality or, as the case may be, the legal representation of the holder.
  • A clear and precise description of the personal data with respect to which you are seeking to exercise any of the ARCO rights.
  • Any other element or document that facilitates the location of the personal data, as well as any other similar document required by the legislation in force at the time the request is submitted.

The Controller shall not be obliged to cancel your Personal Data in the event of any of the exceptions set forth in the Law.

VIII. Revocation.

The owner of the Personal Data may revoke his/her consent for the processing of Personal Data at any time, and must, solely for such purposes, send a free written request to the Area in charge of Personal Data, to the address established in section VI of this Privacy Notice, attaching documentation proving the ownership of the personal data whose consent for the processing he/she wishes to revoke; as well as the address to which he/she wishes us to send the response to his/her request.

We will have a maximum period of 20 business days to inform you about the origin of the claim and, if it is appropriate, it will be effective within the following fifteen business days, counted from the date on which the positive answer is communicated, which will be notified to the address yo provide us for such purpose.

IX. Modifications to the Privacy Notice.

The Responsible reserves the right to make changes or updates to this privacy notice at any time, in order to comply with new legislation, internal policies or new requirements for the provision and offering of our services. These modifications will be available to the public at each of our branches and you can send an email to atencionclientes@fincsa.com.mx requesting the shipment of the same.

If you, as the Data Subject, had provided your email address, the Responsible Party may send to such email address any modification to this Privacy Notice, however we will not be responsible if you do not receive the notification of change in the Privacy Notice in case there is any problem with your email account or data transmission over the internet.
